In general all dismissals are deemed unfair and it is up to the employer to prove that the dismissal followed all reasonable procedures and was fair. If an employer cannot prove that the dismissal was fair then they are more than likely facing a claim of up to two years salary of the employee being dismissed.

So what is deemed as a fair dismissal?

In Ireland, the law on unfair dismissal is mainly set out in the Unfair Dismissals Acts 1977 to 2007. Case law arising from employees making previous claims in court also clarifies the legislative provisions.

The Acts outline what are known as
